Our Boat is fully insured, inspected by the US Coast Guard and have a USCG Master Captain
Boating/Sailing Liability Release Form VESSELS: Calypso and/or Nómada and/or Loki
I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH
CHARTERING/SNORKELING/DIVING, ETC, including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions, and I HEREBY ASSUME SUCH RISKS.
I UNDERSTAND THAT I HAVE A DUTY TO EXERCISE REASONABLE CARE FOR MY SAFETY AND I AGREE TO DO SO.
I assert that I am physically fit to ride on a boat and I will not hold the vessels Calypso and/or Nómada and/or Loki and/or Salt Water Travel LLC (“SWTravelPR”) or their employees, agents, or other associated personnel responsible if I am injured as a result of ANY problems (medical, accidental or otherwise) which occur while chartering the boat or otherwise participating in the trip, including any accident while being transported in a motor vehicle.
I fully understand that the vessels Calypso and/or Nómada and/or Loki have no medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio, and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.
SWTravelPR and vessels Calypso and/or Nómada and/or Loki, have made no representations to me, implied or otherwise, that they or their crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold SWTravelPR or vessels Calypso and/or Nómada and/or Loki, their crew, or passengers responsible for their actions in attempting the performance or rescue of first aid.
I agree to forever discharge and release Salt Water Travel LLC, vessels Calypso and/or Nómada and/or Loki, its employees and agents, the owner(s) of Salt Water Travel LLC, vessels Calypso and/or Nómada and/or Loki, and affiliates, from any responsibility or liability for any injuries or damages. I agree NOT to make a claim against or sue any of the above parties for injuries or damages whether they arise or result from any NEGLIGENCE or other liability, EVEN IN CASES OF GROSS NEGLIGENCE. I further specifically agree, on behalf of myself, my heirs, and assigns, to indemnify and hold harmless the released parties for any causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in any activities with or involving the released parties.
I agree and accept that this document, any claim, litigation, or legal proceeding related to the same shall be subject to and interpreted exclusively in accordance with the Laws of the Commonwealth of Puerto Rico, and that any such proceeding shall be carried out exclusively in the state courts of the Commonwealth of Puerto Rico. If any part of this agreement is held void, illegal, or is declared without legal effect by a court of law, the enforceability, legality, and applicability of the remaining provisions set forth herein shall not be in any way affected or limited.
I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT, FROM THE DATE OF BOOKING, FOREVER INTO THE FUTURE.
SWTravelPR often takes photographs of participants for the purpose of promotion. This form allows participants/guardians the option to not allow SWTravelPR to take photographs of them/their minor children for the purpose of promotion. Failure to exercise this option, releases and discharges SWTravelPR from any and all claims arising out of the use of photographs or videos, or any right that the parent or minor may have.
To exercise the opt-out option, send us an email before the trip and provide the information to SWTravelPR staff. Participants are responsible for communicating their opt-out presence to the SWTravelPR Staff.
SWTravel
